Griffin S. Rubin Provided Pro Bono Counsel to Client in Danger of Persecution for his Political Opinions

In a case before the Immigration Court in Aurora, Colorado, Judge Nina M. Carbone granted withholding of removal to a client seeking refugee status under federal immigration law.

Sbaiti & Company attorney Griffin S. Rubin provided pro bono representation to a Nicaraguan man who is a member of the opposition party in his home country. Nicaragua is wholly controlled by President Daniel Ortega and the ruling Sandinista party. Political dissent is not permitted by the Ortega government—those who speak out against the current regime are targeted by government-controlled forces and persecuted by means of physical violence (e.g., beatings, being “disappeared,” or killed). The client participated in several nonviolent political demonstrations, during which the Ortega regime’s forces beat him and threatened his life if he continued speaking out against the government. He decided to leave Nicaragua and seek refuge in the United States once the Nicaraguan government captured and arrested two of his cousins, who have not been seen or heard from since.

After months of preparation, the client had his individual merits hearing on July 6, 2022. Judge Carbone granted his request for withholding of removal to Nicaragua on account of state-sanctioned persecution for his political opinions.
