Associate Litigation Attorney

We are a small trial and litigation boutique – five lawyers in total right now. We are looking to add an associate to our firm who has the ambition and desire to win by outworking, outsmarting, and out-strategizing opposing counsel at every turn.

The firm is entrepreneurial—we like to bet on ourselves, doing a lot of our work on contingency. Much of our work is on the plaintiff’s side, almost always in the commercial-litigation space, e.g., including matters in finance/securities, healthcare, pharmaceuticals, construction, banking, insurance, and manufacturing. We also work frequently in matters concerning breaches of contract, fraud, tortious interference, breaches of fiduciary duty, whistleblowers, corporate governance, bankruptcy, and intellectual property (patent, copyright, trade secrets). Due to the importance we place on work quality, we also frequently end up on the defense side, and we also end up advising clients on pre-litigation matters. We currently have clients and matters all over the country, including in Dallas, Austin, Houston, Miami, New York, San Francisco, Los Angeles, and Delaware.  

We are looking for a smart and ambitious individual who seeks to forgo the usual trappings of a large law firm and get into court early and often. You don’t have to have your own book of business, but you do need a genuine desire to build one. Your compensation at the firm will consist of base salary, bonuses, insurance, employee benefits, and a percentage of the matters you work on—which readily competes with (and often surpasses) the annual compensation earned at large law firms. Compensation is structured this way because we want the firm to be the incubator and platform for your legal career.

Those looking for a “job” probably won’t like it here, nor will folks looking for a regular 9-to-5 gig. But someone who wants the freedom to build a career as a true litigator, go to court and try cases, and who has a borderline-pathological desire to win will be an ideal fit at the firm.

Our Three Important Values

(1) Our culture. The work is hard enough, so we work hard to select people in line with what we want. We keep the firm culture as relaxed and friendly as possible. We go to lunch together as a firm at times. We have biannual retreats to talk about things. Our paralegals are equal participants in much of this. We have a strict, zero tolerance policy for yelling or personal abuse—and this applies especially to how lawyers treat staff.

(2) Quality of Our Work. We have a high degree of sensitivity to the quality of our work—namely, being right, and being clear and concise. Our written work is our marketing and so far we’ve done really well there.

(3) Client Service. We try to be as responsive to our clients’ needs as possible and as quickly as possible.

Our typical candidates have a federal judicial clerkship under their belts, plus one or two years of litigation experience.

Associate Litigation Attorney Responsibilities
  • Manage litigation matters independently from client intake through final judgment
  • Conduct research and draft pleadings, briefs, and motions
  • Attend court hearings on behalf of clients and argue motions
  • Strategize, prepare for, and attend trial proceedings, mediation, and arbitration
  • Handle discovery, including drafting and responding to discovery requests, resolving discovery disputes, managing e-discovery, and taking and defending depositions
  • Provide guidance and advice to clients
  • Maintain knowledge of local, state, and federal statutes and applicable laws
Associate Litigation Attorney Qualifications
  • Bachelor’s degree with a law degree from an accredited law school (such as an LLM, JSD, or J.D. degree)
  • At least 2 years of litigation experience, preferably with federal clerkship
  • Member of the State Bar of Texas in good standing
  • Must be able to handle heavy workload with little supervision
  • Persuasive writing skills and verbal communication skills are critical, along with time management and interpersonal skills
